A lawsuit challenges a decision by Gov. Tim Walz to schedule a Jan. 28 special election after a November winner was deemed ineligible to take office in the House on Jan. 14.

ST PAUL, Minn. — The saga of who will control the Minnesota House continues after Governor Tim Walz approved a special election in District 40B. The special election will be held on Tuesday, Jan. 28. Walz's office added that a special primary election for the candidates' nominations will be held on Jan. 14, if necessary.

Republicans argued Gov. Tim Walz called for a special election too early and asked for a halt ahead of the legislative session.

The lawsuit comes after a judge granted Republican candidate Paul Wikstrom's contest of the results of the House race after finding his Democratic opponent, Curtis Johnson, did not establish residency in District 40B.

DFL Rep.-elect Curtis Johnson will not be sworn in after a Ramsey County judge ruled he did not meet the residency requirements to represent the east metro district.
